Abstract: The Fair Labor Standards Act's meaning of "regular rate" of pay, although precise, allows for exceptions for so-called wage augments. This article addresses the question of whether employees who are deployed and receive a flat sum of $50 per diem can increase their overtime compensation by claiming they did not spend the entire $50 on meal.
